Terms of Service

Notice: This is a general terms template tailored to eFoil Truckee's services. Review with legal counsel before relying on it. Nothing here replaces the in-person liability waiver required for every rider.

1. About these terms

These Terms of Service (“Terms”) govern your use of efoiltruckee.com and any lesson, rental, or product purchase from eFoil Truckee (“we,” “us”). By booking with us or buying from us, you agree to these Terms.

2. Bookings

Lesson and rental bookings are confirmed when you receive an email confirmation from us. Time slots are weather-dependent; we may reschedule for unsafe wind, water, or air-quality conditions at our discretion. Sessions rescheduled by us due to conditions can be rebooked at no charge or fully refunded.

3. Cancellation and no-shows

  • Full refund if you cancel at least 48 hours before your scheduled session.
  • 50% refund or one-time reschedule if you cancel between 48 and 24 hours before.
  • No refund for cancellations inside 24 hours or for no-shows.
  • Late arrivals shorten the on-water time without changing the rate.

4. Liability waiver and assumption of risk

eFoiling involves a powered hydrofoil board on open water and carries inherent risks of injury, including but not limited to falls, collisions, board strikes, propeller contact (mitigated by Waydoo's prop guard), drowning, and hypothermia. Every rider must read and sign our in-person liability waiver before going on the water. Riders under 18 require a parent or legal guardian's signature. Riders must be able to swim and must wear the safety gear we provide (impact vest, helmet) at all times.

5. Eligibility and conduct

  • Minimum age: 12 for lessons (with guardian on site), 18 to rent unaccompanied.
  • Riders must follow all coach and staff instructions and obey posted lake rules.
  • No alcohol, cannabis, or other impairing substances before or during a session.
  • We may end any session immediately for unsafe conduct without a refund.

6. Rentals

Rental customers are responsible for the equipment from pickup (or delivery) until return. You agree to:

  • Inspect the equipment at handoff and report any pre-existing damage.
  • Operate only within the agreed area and within the battery's safe range.
  • Return the equipment on time, fully assembled, and in the condition received.

Damage caused by negligence, impact with structures, saltwater immersion, or unauthorized use will be billed at the repair or replacement cost. A valid credit card on file is required for all rentals.

7. Product sales (Waydoo Flyer EVO)

Pricing on the site reflects the manufacturer's current MAP. Sales tax and shipping are added at checkout where applicable. Manufacturer warranty terms are set by Waydoo; we honor those terms and assist with warranty claims for products purchased from us. Returns on new, unused equipment are accepted within 14 days of delivery, subject to a restocking fee; opened or used equipment is not returnable except under warranty.

8. Payments

We accept major credit cards via a third-party PCI-compliant payment processor. By providing payment information, you authorize us to charge the agreed amount. Disputed charges should be reported to us first so we can resolve them without involving your bank.

9. Intellectual property

All content on this site (text, logos, photos, video) is owned by eFoil Truckee or our licensors and may not be reproduced without permission. “Waydoo” and the Waydoo logo are trademarks of their respective owner; we use them as an authorized dealer.

10. Limitation of liability

To the maximum extent permitted by California law, eFoil Truckee is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the site or our services. Our total liability for any claim related to a session or purchase is capped at the amount you paid for that session or product. Nothing here limits liability that cannot be limited by law (e.g., gross negligence, willful misconduct).

11. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Nevada County or Placer County, California.

12. Changes

We may update these Terms at any time. Material changes will be posted here with a new “Last updated” date. Bookings made before a change are governed by the Terms in effect at the time of booking.
